As applied to the examination of witnesses, this phrase ts equivalent to “orally.” It is used in contra-distinction to evidence on affidavits or depo-sitlons. As descriptive of a species of voting, it signifies voting by speech or outcry, as dis-tinguished from voting by a written or print-ed ballot
